The applicant represents the information contained on this application to be correct and true and authorizes RBI Corporation to request the credit information on this company. The applicant agrees (a) to pay within terms stated on invoice for all products ordered from and shipped by RBI Corporation, (b) that all cash discounts are based on payment by the discount date noted on the invoice, and apply to qualifying merchandise only, (c) to pay service charges of 1.75% per month on past due balances, and (d) to pay all collection and legal fees in the event an outside agency is employed.
Guarantee
In consideration of the extension of credit by RBI Corporation to applicant, the undersigned does jointly and severally personally guaranty to pay and be responsible for payment (and not merely collection) of all invoices in accordance with stated terms, attorney's fees, and costs of collection the seller may incur in enforcing the terms of this agreement. If legal action becomes necessary by either seller or buyer it is also agreed that this or any contemporaneous or subsequent agreement, will be governed as to validity, interpretation, construction, affect, and in all other respects by the laws of the Commonwealth of Virginia.
